National Vaccine Injury Compensation Program

Our Law Firm Helps Victims of Vaccine Injury Navigate the Complex Program at No Cost

national vaccine injury compensation programWhile injury from vaccines are rare in the United States, they do occur. Prior to the National Childhood Vaccine Injury Act (NCVIA) of 1986, lawsuits were threatening the supply of much needed vaccines due to manufactures putting a stop to production. When congress passed the NCVIA, they created a no-fault insurance program designed to financially compensate victims of vaccine-related injuries, and to ensure the supply of vaccines, and stabilize costs. The U.S. Court of Federal Claims decides who will be paid. There are three Federal Government offices that are involved in the VICP:
•    The U.S. Department of Justice
•    The U.S. Department of Health and Human Services
•    The U.S. Court of Federal Claims

In 1988, the National Vaccine Injury Compensation Program went into effect, and the Vaccine Injury Compensation Trust Fund began to provide funding by collecting excise taxes of $.75 from each dose of vaccine sold.

DID YOU KNOW? Filing a claim for a vaccine injury is unlike a traditional lawsuit. The injured party does not pay a percentage of awards to the attorneys’. The costs and fees are paid separately from any awarded compensation. That means you pay nothing by working with experienced vaccine injury lawyers who work hard to get the maximum compensation for you.

At the Law Firm of Marvin Firestone, MD•JD, & Associates, LLP, our knowledgeable attorneys represent injured clients in all 50 states nationwide. Our website offers more information for the following:

Who Can File a Vaccine Injury Claim?

If you or a loved one have been injured by a vaccine , or if you are the legal representative of the estate of a deceased individual who died from a vaccine reaction, then you may file a claim as long as the vaccine is covered by the NVICP. You must meet other requirements such as providing medical proof that the injury or death was caused by the vaccination, and you must file your claim within the time limit (also called the statute of limitations). Claims must be filed with the U.S. Court of Federal Claims and for a $400 filing fee, must include the claim, a Court of Federal Claims cover sheet, and related documentation including medical records.

What is the Time Limit To File a Claim (statute of limitations)?

There is a time limit to file (also called the statute of limitations), which is three years after the first symptom of the vaccine injury, or within two years of death and four years after the beginning of the first symptom that resulted in death. If you or a loved one have been injured from a vaccination, you can work directly with a vaccine injury lawyer who can help you navigate the complex program so you can maximize your compensation in a timely manner. The attorneys at the Law Firm of Marvin Firestone, MD•JD & Associates offer free consultation and representation (legal fees are paid by the NVICP).

Do I Have to Work With A Vaccination Injury Attorney?

There is no requirement to work with a vaccination injury attorney when filing with the National Vaccine Injury Compensation Program (unless the victim is not of legal adult age, or is incapable of representing themselves). However, the program can be very complex to navigate, legally complicated, and you risk the chance of not getting the maximum compensation you need. Our lawyers can do all the work on your behalf, and are experienced in getting the maximum compensation for our clients nationwide. You pay NO FEES to our law firm because the NVICP pays all costs and fees. This means you pay nothing for our experience, knowledge, and dedication to getting you the compensation for your injuries that you deserve.
