The National Vaccine Injury Compensation Program Will Cover Your Attorneys Fees.
That Means You Pay Nothing.

The National Vaccine Injury Compensation Program (VICP) was created in 1988 under the National Childhood Vaccine Injury Act of 1986 when lawsuits against the various vaccine manufacturers caused the potential for shortages of vaccines. Under the program, the U.S. Court of Federal Claims decides who will be paid. The Vaccine Injury Compensation Trust Fund (VICTF) provides the funding for the NVICP by charging a $0.75 excise tax on each dose of a vaccine in the United States, and pays out compensation for injuries from specific vaccines that are covered by the program.

The VICP covers all reasonable costs and legal fees which are paid out separately from the compensation award. That means you pay nothing to have an experienced legal team to help you navigate the program, from the initial filing of your claim to court appearances and even litigation, if needed, so you can get the maximum compensation for your injury and suffering.

Frequently Asked Questions

  • What is the National Vaccine Injury Compensation Program (NVICP)? +

Prior to the National Childhood Vaccine Injury Act (NCVIA) of 1986, lawsuits were threatening the supply of much needed vaccines due to manufactures putting a stop to production. When congress passed the NCVIA, they created a no-fault insurance program designed to financially compensate victims of vaccine-related injuries, and to ensure the supply of vaccines, and stabilize costs. The U.S. Court of Federal Claims decides who will be paid. In 1988, the National Vaccine Injury Compensation Program went into effect, and the Vaccine Injury Compensation Trust Fund began to provide funding to individuals who have been injured by vaccines by collecting excise taxes of $.75 from each dose of vaccine sold. • How do you file a vaccine injury claim? +

You may file a claim if the injury lasted longer that six months after the vaccination occurred, or resulted in surgery or hospital stay. The vaccine must also be covered by the Vaccine Injury Compensation Program. Working with a vaccine injury lawyer is not a requirement (unless the victim is not of legal adult age, or is incapable of representing themselves), however, since the process is often very difficult, involving complicated medical and legal issues, it is strongly advised to work directly with an attorney. All legal costs and fees are paid by the program. Read More

  • Does my attorney need to be local? +

  • What are the deadlines to file a vaccine injury claim with the NVICP? +

  • What is the Vaccine Injury Table? +

The vaccine injury table is a list that details conditions and injuries that are thought to be caused by certain vaccines. The Qualification and Aids to Interpretation (Aids) help to define many of the conditions and injuries that are listed on the Vaccine Table. Time periods are listed, showing when the 1st symptom of these conditions/injuries must occur following vaccination in order to receive the Table presumption. If the 1st symptom happens within the listed time period, and any related definitions included in the Aids are satisfied, it will then be presumed that the vaccine was the cause of the condition or injury, unless another cause is discovered. If you cannot find your specific injury on the Table, or did not satisfy the Table requirements, you then must prove that the vaccine caused the injury. To obtain a copy of the latest Table and Aids, visit the VICP Website at: http://www.hrsa.gov/vaccinecompensation/vaccinetable.html Read More
